Project Summary:

The USAID Legal Professional Development and Anti-Corruption Program (LPAC) is five-year project implemented by Checchi and Company Consulting and consists of two components. The first component directs capacity building to the four key Liberian justice sector institutions that educate, regulate and inform legal professionals. The second component, under a sub-contract with MSI, supports the Liberian Anti-Corruption Commission (LACC) and associated Government of Liberia entities in their efforts to investigate and prosecute corruption cases, supports enhancing organizational structures and systems of the LACC, promoting education, outreach and prevention activities, and assists the LACC in its anti-corruption leadership and coordination roles.

Position Summary:

Over the course of three years, LPAC has built the capacity and skills of Liberian investigators and prosecutors to investigate and prosecute complex corruption cases. As a result of these efforts, the quality of investigations has increased significantly, and more cases have been thoroughly investigated and prepared for prosecution in court. However, the Liberian court system is overburdened with its case load, causing a lag in prosecutions. Furthermore, corruption cases, even those of high profile and involving significant financial losses, are not prioritized in the court system. Finally, judges often lack experience presiding over complex corruption cases. As a result, the GoL and non-governmental stakeholders seek to establish a court dedicated to adjudicating corruption cases.

LPAC seeks a consultant with expertise and experience drafting anti-corruption legislation and establishing an anti-corruption court. The consultant will review relevant Liberian polices and legislation; analyze current prosecution practices in Liberian court cases; conduct meetings and interviews with experts in governmental and non-governmental sectors, eliciting their views and experience; and draft a concept paper for legislation to establish the Anti-Corruption Court based on the collected information, applicable international experience, and best practices. The consultant will discuss the concept paper with stakeholders to reconcile different views and build consensus around the Concept and finalize the document.

The consultant will be supported by the LPAC technical staff with expertise in investigation, prosecution and legal drafting. The assignment is scheduled for September October 2019 including two trips to Liberia.

Responsibilities and Deliverables:

  • Review Liberian legislation and institutional framework relevant to prosecuting corruption cases in court in Liberia.

  • Analyze current practices with prosecuting cases in court in Liberia.

  • Conduct meetings and interviews with Liberian experts in governmental and non-governmental sectors, eliciting their views and experience.

  • Draft a concept paper for legislation establishing the Anti-Corruption Court in Liberia, taking into account Liberian context, applicable international experience, and best practices.

  • Discuss the draft Concept Paper with stakeholders in Liberia, seeking agreement on the primary provisions of the Concept and finalize the document.

Required Qualifications

  • Masters degree in law, political science, public policy, public administration or other relevant field.

  • At least 5 years of experience in legal drafting and court system.

  • Experience presiding over corruption cases in court is preferred.

  • Proven knowledge of relevant international experience in anti-corruption court legislation and establishing an anti-corruption court.

  • Demonstrated analytical, policy development, and legal drafting skills.

  • Excellent organizational skills and ability to meet deadlines.

  • Prior experience with international development projects is preferred.

  • Experience working in Liberia or similar countries is strongly preferred.

  • Fluent English language is required with strong oral and written communication skills.
